AICA will not assume to own as that term is understood in copyright law unassigned or assigned copyright in any Aboriginal or Torres Strait Islander intellectual property rights; either recognised by law or by Aboriginal or Torres Strait Islander traditions or customs except for documents that are exclusively brought into existence by AICA. AICA will ensure that any Aboriginal or Torres Strait Islander copyright assigned to AICA, where possible, is by written copyright license, either Non-Exclusive or Exclusive. AICA will also ensure that any assigned copyright to AICA that belongs to either a community or individual, is only by informed consent from either the community or individual and to be used only in accordance with the copyright license or by written agreement from the community or person concerned. To ally any doubt about AICA and Aboriginal and Torres Strait Islander traditional rights and interests acknowledged in law as intellectual property or Aboriginal or Torres Strait Islander traditional laws or customs, ownership and management of such intellectual property used by AICA are to be governed by AICA Intellectual Property Policy and applicable laws. |
